Burningham & Brown are Private Client Solicitors and we provide legal services for our Clients in Residential and Commercial Conveyancing, Wills, Lasting Powers of Attorney and Probate and Family matters.

We are totally committed to protecting the privacy, security and confidentiality of our Clients data. We take every measure to safeguard any personal information we collect about you in accordance with GDPR and The Data Protection Act 2018. We use the information you provide primarily for the provision of legal services to you and for related purposes; including updating and enhancing Client records, analysis to help us manage our practice, statutory returns, legal and regulatory compliance.

Please note that our work for you may require us to give information to third parties such as expert witnesses and other professional advisors; including our regulators the SRA (Solicitors Regulation Authority) and the CQS (Conveyance Quality Scheme). We follow the six data principles of GDPR in that your personal information is:

1.     Processed fairly and lawfully and in a transparent manner

2.     Obtained and processed only for specified legitimate purposes

3.     Is adequate and relevant and limited to what is necessary

4.     Is accurate and kept up to date and inaccurate data must be rectified or erased

5.     Is kept no longer than is necessary

6.     Is protected against unauthorised or unlawful processing, accidental loss or damage.

What information do we collect about you?

We collect personal information in two ways; firstly information that you consent to provide to us by filling in our email contact form on our website (https://www.burninghambrown.com/). In addition, we handle personal information at our office given to us by our Clients or other parties in the course of providing services to you. The lawful basis we have to handle this information is:-

  • The performance of a contract with you (for the services that you are asking us to provide)
  • Necessary to comply with legal obligation (such as our own record keeping)
  • Necessary for our legitimate interest (such as running our business).
  • Where you have given consent (such as completing our Client Identity Questionnaire).

If you disclose to us any personal information about another person (such as an Executor of a Will), you must obtain the persons consent to the disclosure and handling of the personal information in accordance with this Policy.

How we use this information

We use this information to provide our legal services to you. There are some circumstances where this information must be shared with other parties and these include:

1.     Regulatory Bodies to comply with our Legal and Regulatory obligations

2.     HM Land Registry and HMRC (relating to your transaction)

3.     External Auditors

4.     Bank, Insurers and Brokers

5.     Some service providers such as our IT providers.

We will only use service providers that demonstrate compliance with the Data Protection Law and will use your information to provide a service to ourselves and our Clients. We will never sell, distribute or lease your personal information.

Keeping your information

We will hold our Clients' information given to us in our office for as long as it is needed to be able to continue to provide the services to you or to comply with our Professional and Legal obligations.

Access to information

You have the right to access a copy of any personal information that we hold on your behalf and please do not hesitate to email or write to us at the below address if you wish to have this information. You may also ask us to correct or remove information that you think is inaccurate. You have the right to request that we delete your information and you also have the right to request that we transport or transfer your information either to you or another service provider.
